Waqf administration

Waqf Administration in contemporary society Dr Hisham Dafterdar Chairman Awkaf Australia Ltd One of the important issues concerning awqaf is the appointment of an administrator (nazir or mutawalli) to manage the waqf. Shariah provides a principles-based criteria to the appointment of the nazir and to his duties and responsibilities. The guiding principles for the task of the nazir are based on three defined parameters: protect, respect and manage. These principles are not independent from each other and must be maintained and reflected in the nazir’s exercise of his duties and responsibilities. The donor (waqif) through the waqf deed determines the objectives of the waqf and designates the nazir and his successors. In many cases, especially in family awqaf, the nazir is the waqif himself or his eldest son, then to be succeeded by other descendants. The nazir holds the title of the waqf property, exercises legal control and is bound by fiduciary responsibility and moral obligation to protect and administer the waqf for the benefit of the beneficiaries in accordance with the terms of the waqf deed. Nazirs are expected to comply with both the letter and spirit of the waqf document. The importance of the conditions of the waqif is indicated by the much-quoted maxim: “The conditions of the waqif have the same legal force as the edicts of the legislator”. However, the real challenge for the nazir is not what’s in the waqf document, but what isn’t in it. This means that if the waqf document is silent on a particular matter, then the issue should be referred to an appropriate higher authority for an opinion or decision. However, Nazirs have some “wiggle room” on many issues. Unlike legal rules which generally dictate what should be done without deliberation, Shariah principles enable the nazir to weigh the facts and decide what should be done in many situations he faces. To a large extent, the task of the nazir has become formalistic and ritualized. This style of nazara has become more of a barrier to new awqaf than an attraction for more. No one goes to the university with the aim of becoming a nazir and there aren’t as many people qualified for the job. The authority of the nazir to act and make decisions on behalf of the waqf carries an immense responsibility and his duties are wider and more onerous than they are assumed to be. The role has evolved beyond the traditional duties of oversight and will continue to increase in significance. Nazirs should have a certain level of business skills and investment knowledge to support their role in monitoring the safety and performance of assets under their control. The task requires a multi-disciplinary approach, combining an understanding of Shariah, awqaf, sociology and finance. The nazir should be able to communicate and interact with different groups and be ready and able to reconcile and balance when he finds different interests and mindsets colliding. Because of the nature of awqaf, its religious message and social application, it seems logical that those who are entrusted with the custody and management of awqaf properties are more religiously conscious and adhere strictly the literal wording of the waqf. They employ their faith when investing, and when things go wrong, they tend to believe that salvation is imminent, and that divine succour is just around the corner to solve all financial difficulties. With such an attitude, nazirs are more of a business risk than a service to the waqf. By not taking active interest in developing awqaf assets, nazirs could be costing their organisations and beneficiaries thousands in missed opportunities. In this stance, aptitude is more important than attitude. Nazirs have the responsibility to safeguard and grow assets in their custody and produce returns rendering it harder to act solely on their beliefs. Investment knowledge and development should be basic requirement for the nazir and not just an optional add-on. While it is expected that nazirs would live by their ethical principles and always choose to do what’s right, awqaf history tells us a different tale. Awqaf nazirs have been portrayed as gurus of greed and deceit. Awqaf’s landscape has been tarnished by numerous scandals of awqaf that were hijacked by their nazirs. Historian Daniel Crecelius wrote about numerous cases of complaints raised to the qadis against corrupt nazirs withholding funds for the upkeep of awqaf for which they were responsible, and about nazirs not distributing benefits properly. Some nazirs became fortune hunters “converting the waqf into private property”, (Gibb and Bowen II 1957: 177-78). Nazirs are not angels. They are fallible creatures and can slide into unethical conduct unaware of any wrong-doing. Due to unscrupulous actions of certain nazirs, awqaf has lost much of the respect and trust of the community and hand-in-hand with that, credibility. The perpetuity of the waqf creates issues of succession and highlights the need for the corporate nazir. A waqf foundation, as an incorporated entity has obvious advantages. It has an indefinite life and a legal personality independent of its members. The corporate nazir is the best hope for awqaf. The corporate nazir can bring in new blood and ideas which are beneficial to the waqf without interrupting the nazara function. Nazara succession becomes a process and not an event that ensures harmony and continuity of the waqf to subsequent generations. A foundation has a board of directors, and allows the segregation of duties and allocation of responsibilities according to areas of specialisation. It can adopt a governance structure that ensures transparency and disclosure, control and accountability, and sets a code of ethics and boundaries of behaviour. A board of directors overseeing the waqf would be able to hold the balance between social and economic goals and between beneficiaries and communal interests. The corporate structure underlines the need for licensing regulations where nazirs or waqf administrators need to be certified and licensed. The certification of nazirs sets a process of prescribed academic qualification, work experience and character references to ensure that awqaf nazirs possess the highest level of professionalism. Just as company law stipulates that public companies appoint an auditor, awqaf governance laws should also make it mandatory for waqf foundations and nazirs to be audited. Any conflict between the nazir’s obligations and his self-interests, should lead to penalties or to revoking of the nazir’s license. Awqaf is an ethical business sector and the nazir is at forefront and in the most noticeable position. Every time an awqaf nazir speaks at an event covered by the media, the entire awqaf sector is on the line. Nazirs should act in the interest of the entire community and the concerns of non-beneficiary stakeholders should form part of their responsibilities. Nazirs are not only required to act in good faith for the best outcomes for the waqf, but also ensure others see them acting diligently and building trust among those they deal with. They should act as models of behavior to change the traditional image as persons who are insular, ignorant, rarely listen, and hardly interact. Nazirs are empowered and trusted because stakeholders believe that they will make a difference, create change and improve lives by acting professionally, honestly and compassionately. A few words about investment and debt Cara Santos Pianesi, 2019/10/25 Image credit: Shutterstock, Tom Mc Nemar On this blog, we speak a lot about investments—particularly private-sector investments in productive, sustainable developing-country infrastructure. Today we insert a word of caution, one that perhaps complicates the picture and makes strong analysis of each country’s needs and resources more important. Public debt in developing countries has been increasing and the share of the world’s poorest countries at high risk of external debt distress has doubled since 2013. The median interest payment among low-income countries rose 128 percent between 2013 and 2017, while government revenues grew just 31 percent. This rise in debt-servicing costs has left many governments with less to spend on critical public services. These developments pose a challenge to the global effort to end extreme poverty and achieve the SDGs by 2030. Governments need to find ways to finance these investments without letting debt grow to unmanageable levels. This is not easy. Here, debt transparency is critical. Policymakers in borrowing countries need reliable debt information to make informed borrowing decisions. Creditors, donors, analysts, and rating agencies need it to assess sovereign creditworthiness, and to appropriately price debt instruments. Citizens need it to hold their governments accountable. The World Bank Group takes a comprehensive approach to enhancing debt transparency—through its own engagement with countries and in close collaboration with the IMF. Also together with the IMF, we have tools and expertise that can help countries manage their debt more effectively. We just launched version 2.0 of the Public Fiscal Risk Assessment Model (PFRAM), an analytical tool to assess fiscal costs and risks arising from PPP projects. It’s designed to assist governments in assessing fiscal implications of PPPs, as well as in managing these projects proactively. Since it was launched in April 2016, PFRAM has been used in the context of IMF and WBG technical assistance, as well as by country authorities (for example, PPP units in Ministries of Finance, public corporations) to better understand the medium- to long-term fiscal implications of PPPs. Building on experience gathered from developers and users, this new version improves the user interface making it easier to understand by non-PPP experts and extends the tool’s coverage and functionalities.  We’ve also launched launched a new, self-paced course on assessing fiscal implications and managing related fiscal risks—using real case studies to explain key concepts and includes downloadable resources for later use. ADVERTISEMENT The business mogul, who is the Chancellor of the University, had also acquired land for the construction of 15 residential houses for 15 foreign professors he sponsored to teache in the university. Similarly, Dangote is building two Industrial boreholes with the capacity of 15,000 each. According to the Vice-Chancellor, the Chancellor of the university had acquired land for building two hostels with capacity to accommodate 500 students each. This, he said would ease the hostel accommodation challenges faced by students of the university. He disclosed that the university had within the last three years secured the accreditation of 21 of its programmes with 19 having full accreditation while the remaining two have interim accreditation. “I am happy to inform you that there is no single course being run by the University that does not have accreditation by the National Universities Commission (NUC),” he said. The Vice-Chancellor said two of the three new faculties would commence operation in 2019 while the remaining one would take off in 2020. “The faculties of Pharmaceutical Sciences and Veterinary Science will start operation in 2019 while the faculty of medical sciences will take off in 2020,” he said. He said the technical committees set up to see to the establishment of the faculties would soon be inaugurated. “We have signed an MoU with seven foreign universities including Sarakawa University in Malysia which we will collaborate with in renewable energy”. I've always loved the flavor of ginger. The experts say ginger root is a stellar anti-inflammatory, improves heart health, eases nausea and motion sickness, helps expel free radicals from the body, and is even linked with lowering cholesterol. If this spicy root has this much power, I just had to test it out. I decided to consume fresh ginger every day for seven days. While there are many ways to consume it, I opted to head straight to my juicer each morning for a ginger and lemon shot and continued my ritual with a cup of homemade ginger tea at night. Whipping up the tea is easy; you simply pour a cup of boiling water over a hunk of raw ginger and let it sit for a few minutes. I almost immediately noticed its digestive powers. I'll be totally candid here: when it comes to bathroom habits, I've never been regular. Switching to a healthier diet certainly helped (healthier meaning I will never give up cheese), but even my favorite cruciferous vegetables can be triggers for cases of all-day bloating. The effect of fresh ginger was quick — by the third day, I was going to the bathroom at the same time every morning like clockwork. I also noticed a significant reduction in after-dinner bloating when finishing my meal (broccoli and all!) with a cup of ginger tea. It eased my muscle pain post-workout. I'm a huge advocate of the benefits of weight training for women, and I tend to push myself pretty hard in the gym. By midweek, I noticed that my onset soreness, while still present, felt noticeably milder than usual. I'm a firm believer in utilizing all-natural remedies in lieu of medication whenever possible. I use peppermint oil for headaches and drink raw honey when I have a sore throat. But for my workouts, I typically take two anti-inflammatory pills each morning to help ease the pain, and I can totally get behind the idea of drinking ginger instead. I craved my evening tea. Even for someone who loves the flavor, my morning shot was a tad too pungent for my taste. My juicer recommended adding other spices like turmeric, and in the future, I would, but I wanted to give this an accurate evaluation. But my homemade tea? Now that was a little treat I looked forward to each evening. In fact, as an added benefit, it even helped cut any late-night snack cravings. Will I keep going? While I'm not sure I will continue taking it in pure shot form, I definitely plan on ending my days with the tea. I couldn't believe how simple (and, frankly, how cheap) it was to make each evening, considering the holistic benefits I felt almost immediately. As I mentioned, drinking it right before bed reduced my urge to reach for a midnight snack, and if the small but mighty root continues to help my digestion and reduce post-workout pain, count me in. It might be summertime, but I can't wait to enjoy the scratch-made ginger tea in the colder months (with a little honey. . . maybe even bourbon, too).

Mohammed bin Salman was visiting the Kaaba in Mecca, to which Muslims around the world pray five times daily, in order to inspect the construction work underway to renovate and expand the vast Grand Mosque complex surrounding it, known to Muslims as the Masjid al-Haram. They suffered varying injuries of different degrees, he added. One person was seriously injured, sustaining a head wound, according to the health ministry. The Gaza health ministry spokesman said there were no Palestinian fatalities in the clash. Palestinian media reported that the rioters tried to breach the security fence, but were driven back by Israeli gunfire. In response to the riot, Israeli tanks shelled two Hamas observation posts near the border, the army said. The military said during the riot, dozens of Palestinian rioters burned tires and threw improvised explosive devices at the security fence surrounding the northern Gaza Strip and the Israeli troops on the other side. “An IDF soldier was injured apparently by an explosive device that was thrown at him,” the army said. After doctors worked to stop the bleeding to his neck, the soldier was taken into surgery, the hospital said. The Sunday night clash came two days after a massive border riot in which an Israeli Border Police officer from an undercover unit was lightly wounded by shrapnel in the leg when a pipe bomb exploded next to his team, police said. An Israeli Military Intelligence assessment released last Wednesday warned that Hamas, the terror group that controls Gaza, may seek to spark a war with Israel in the near future in an attempt to elicit international sympathy and an influx of international aid money to the Gaza Strip. The IDF believes Hamas or the Iran-backed Palestinian Islamic Jihad, the second largest terror group in Gaza, could attempt to draw Israel into a war by conducting an attack along the border — an anti-tank missile strike, an ambush from an as-yet-undiscovered tunnel or a similar low-level but significant attack. In light of this view, IDF chief Lt. Gen. Aviv Kohavi, whose tenure began last month, called for the military to update operational plans for fighting in the Gaza Strip. GM sat on top of the Fortune 500 companies for so long during which there was “no vacancy” at the top. All the other contestants were vying only for second place. Today GM is no longer the company presidents fear to offend. Others have taken the coveted top spot.  Nigeria Economy Political standoffs will not affect policy continuity in Nigeria – Larbie Nigeria also had its own “GM” for decades. It was called the United African Company, UAC. Until the early 2000s, UAC was the leader of the Nigerian Organised Private Sector, OPS. Its shares quoted on the Nigerian Stock Exchange, NSE, constituted about 30 per cent of the value of the stock market. At the peak of its prowess, UAC had up to 40 Divisions; some with several branches. No government, military or civilian would contemplate an economic policy measure without consulting the Chairman/Managing Director of the UAC – before the Buhari regime in 1984-5. Buhari altered the relationship between the leadership of the OPS and the Federal Government. Nigeria is still paying for that drastic mistake till today. More pages are needed to explain how that delicate balance of powers prevented economic disasters before 1984-5 than is available now. It is merely sufficient to point out that a year after the Buhari/Idiagbon regime sidelined the OPS and UAC, thereafter the country went into its first recession since independence in 1960. For every folly of their princes, the Greeks feel the lash—Horace, 65-8 BC. And for every folly of their governments – federal state or local government – Nigerians are feeling the whip. And, the end to suffering is not in sight. Certainly not in 2019 which is already a disaster before the first month ends. Two prominent Nigerian chief executive officers, CEOs, of UAC during the period under review were Chief Abebe, the first Nigerian CEO and Chief Ernest Shonekan, GCFR. While the Head of State, civilian or military ruled the polity; they virtually ruled the economy. To some extent, it could be said then that “what was good for UAC was good for Nigeria.” At the very least, it was the largest private employer of labour – directly or indirectly. That today UAC is no longer the largest company in Nigeria, either in terms of turnover or jobs was mainly brought about by Federal Government policy measures which transferred the vast majority of UAC’s businesses depending on imports to local businessmen – usually party members or those close to the corridors of power. Whereas UAC, as a company with reputation to protect would import television sets and other appliances and pay correct duties, smugglers were allowed to bring in the same items, bribe Customs staff and openly display and sell their imports at a cheaper price. The first UAC Division to feel the lash was Kingsway Stores – the first supermarket in Nigeria. Successive FGs made sure that Kingsway was liquidated. Its first store at Marina reminds those old enough of when Nigeria had a government in the real sense of the word. Those who do not remember the past are condemned to repeat it—George Santayana, 1863-1952. Moving fast forward one can observe that history is about to repeat itself. In the last ten years or so, the Dangote Group of Companies, DGC, had become the largest group on the NSE. For years, they moved the stock exchange forward – just as UAC did in its heydays. They made money and the investors in DGC were happy to be on board. In the process, Alhaji Aliko Dangote, perhaps the most patriotic Nigerian alive, rose to become one of the top 25 richest people on earth and the richest African. To be honest, I was proud of him. There are very few positive measures of success known to man in which an African, and a Nigerian for that matter, ranks top 25. It was an achievement worthy of national celebration. To me the national honours given him was not enough. He had done more for Nigeria than all our post-Independence national leaders – except one. But, there was always that fear that another FG might do to DGC what was done to UAC; that those who once invested heavily in DGC would not suffer the same fate as those who slaved to make UAC great. Unfortunately, that is precisely what might be happening now. The latest Forbes list of the world’s richest people was heart-breaking. Dangote is now down to 100 richest and he has lost money – virtually all of it here in Nigeria. To non-economists, it might appear as if this is crying more than the bereaved. That is understandable. What they fail to realise is that Dangote, Adenuga, Otedola etc listed among the world’s richest invariably attract Foreign Direct Investment, FDI, to Nigeria which the rest of us cannot. And, the richer they are, the more foreign investors want to discuss investment opportunities in Nigeria with them. Certainly, nobody needs to be told that a nation which acquires the reputation of making its business people poorer will find it extremely difficult to convince most foreigners to invest in its economy. The economist …must concern himself with the ultimate aims of man —Alfred Marshall, 1842-1924. Those consumed by envy might not understand why a “thousandnaire” would worry about the problems of a dollar billionaire. That is where professional economists differ from our Fellow Countrymen. The injunction from one of the founding fathers of our profession was not for us to concern ourselves with our own economic aims and objectives. It did not even enjoin us to strive to be rich. Instead, it was an admonition to economists to take care of the greatest number of their fellow citizens. That means drawing attention to those events which might have long term negative repercussions for the nation. To be quite candid, Dangote represents only a pervasive problem with the Nigerian economy. There are several hundred others caught in the vice-grip of uncertainty regarding when the Nigerian economy will again grow at six to seven per cent a year. This year is out of the question. The 2019 Budget delivered two days before December recess by the National Assembly, NASS, and in the middle of campaigns, will not be signed until at least May this year. The appropriations are less than the 2018 budget which will result in, at best, two per cent growth. The World Bank, the International Monetary Fund, IMF and other global organisations predict 2.2 per cent for 2019. With population increase still racing at about three per cent, Nigeria will add about five million to its poor population. Per capita income will drop a bit more and so will purchasing power. Dangote and other patriotic Nigerian entrepreneurs have done their duty by Nigeria. They have sown joyfully; but they are almost harvesting in tears. If they stop, everyone in Nigeria will be in real trouble – not just people in Borno, Katsina and Zamfara States. The most important question now is: For how long must misguided government economic policies ruin our nation while we do nothing? This year like others has only twelve months. At least five will be spent with nobody thinking about how to prevent more deterioration. The remaining seven months cannot possibly reverse the accumulated damage – unless a new and radical solution is found.
